These terms and conditions apply to the use of this website at palmspas.co.uk and related services. By accessing the website palmspas.co.uk and/or placing an order, you agree to be bound by these terms and conditions. Using this website indicates that you accept these terms regardless of whether or not you choose to register with us or order from us. If you do not accept these terms, do not use this website.

Terms and conditions introduction

You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.

We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then-current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

Ordering from us

Deposits and booking fees will cover the product being reserved for you (the customer) until delivery/ or collection. Deposits and booking fees are £400, all deposits are NON refundable. You may be able to transfer the deposit to another product that we offer but if wanting to cancel order deposits and booking fees are NON refundable. Please make sure you fully understand this before placing an order.

You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.

Our acceptance of an order takes place when we despatch the order or send you confirmation by email. When we despatch the order or send you confirmation by email the purchase contract will be made and you will be charged, unless we have notified you that we do not accept your order or you have cancelled your order.

We may refuse in our discretion to accept an order:

• Where we cannot obtain authorisation for your payment;
• If there has been a pricing or product description error;
• If you do not meet any eligibility criteria set out in our terms and conditions;
• Services or information ordered by you are not available;
• Where goods, services or information ordered by you are not available;
• If we do not deliver to your area;
• Where we do not accept your order but have processed your payment, we will re-credit your account with any amount deducted by us from your debit or credit card as soon as possible, but in any event within 30 days of your order.

We will not be obliged to pay any additional amount as compensation for disappointment.

Pricing

All prices include VAT (where applicable) at the current rates. We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.

Delivery

We will deliver goods ordered by you as soon as possible to the address you give us for delivery, but in any event within 60 days of your order. (Excluding products made to order e.g swim spas.)
If the goods we deliver are not what you ordered or are damaged or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us in writing, at our contact address, of the problem within 10 working days of the delivery of the goods in question

If you do not receive goods ordered by you within 60 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 days of our maximum delivery period of 60 from the date on which you ordered the goods.( excluding products that are made to order- e.g Palm spas.)

If your order isn’t in stock at the time of ordering, all dates given are based on ETAs. These often fluctuate as we can’t guarantee vessels arriving on time. Rest assured as soon as your hot tub arrives, a member of our logistics team will call you to arrange delivery/collection.

Product liability

If you do not receive goods ordered by you within 60 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 10 days of our maximum delivery period of 60 from the date on which you ordered the goods

If you notify a problem to us under this condition, our only obligation will be, at your option:

• Make good any shortage or non-delivery;
• Replace or repair any goods that are damaged or defective; or
• Refund to you the amount paid by you for the goods in question in whatever way we choose.

Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under the clause above.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We will not be liable for consequential losses where you have not kept those costs to a minimum. You should contact us in advance before incurring any such costs.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

Cancellation of contracts for goods and returns policy (for consumers only)

This section applies to consumers only (and not to businesses or other organisations) who order goods.

If you wish to cancel your order:

You can notify us by email to info@palmspas.co uk before we have dispatched the goods to you.

You can return goods you have ordered from us for any reason at any time within 14 days of receipt for a full refund or exchange. The costs of returning goods to us shall be borne by you, the cost of returning spas will be £500. Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required, less (if for any reason the these costs have not been paid by you) the costs of delivery to us.

The rights to return the goods to us will not apply in the following circumstances:

• In the event that the product has been used
• To any products that we have made or customised specifically for you

The provisions of this clause do not affect your statutory rights.

You are permitted to print and download extracts from this Website for your own private use on the following basis:
